If you have a sex change operation, are you still legally considered your original (birth) sex, or is it?
legally changeable?
So if you go from male to female, are you still considered legally a male? Or is there a way you can change your legal sex after an operation?
I'm not interested in this, or against or for it, just curious. Thanks.
So I guess in those 47 states, it is possible to have a same sex marriage, because if you marry, then have your sex change, and change your sex legally, and stay married, you would have a same sex marriage. Even though not all of those 47 states allow same sex marriage. Interesting!
It will depend on the jurisdiction from which your birth certificate was issued.
In states like Idaho, sex changes are not recognized. So if you were born in that state and had a sex change, you could not change your birth certificate. In cases like this, you are still "legally" the sex you were originally assigned.
In California, once you have a sex change operation (sex reassignment surgery), you must appear in court with the proper surgical documents and present them to a judge, who will then authorize as legal sex change. Your birth certificate will then be changed and a new one will be issued.
Most civilized countries do recognize sex changes and will reassign the person's sex.
Justin Snow's information is incorrect. A person's sex IS determined by the genitals, not internal organs or chromosomes. There are many intersex conditions to which individuals can only be assigned a sex based on genitalia. Such intersex conditions such as Androgen Insensitivity Syndrome and Congenital Adrenal Hyperplasia are conditions where a baby can be born with XY (or XX) chromosomes, but the genitals appear as the opposite sex. Or in other cases where a baby is born with XXY. The external genitals will determine what sex they will be assigned. In cases of ambiguous genitalia, the baby will be assigned a sex preferred by the parent, then raised. Some do have corrective sugery once they are mature enough to choose which gender they want to live in. There is NO SUCH THING AS HUMAN BEING BORN AS HERMAPHRODITES. This is a very common misconception. Only lower forms of animals such as snails and worms are born hermaphrodites. In the old days, they use to call babies born with ambigous genitals "hermaphrodites", but the term was dropped for obvious reasons. They are now referred to by their intersex condition such as partial androgen insensitivity syndrome.
Transvestism is NOT the same as transsexualism. Transvestism is a fetish, not a gender identity condition.
For those who choose to live in the opposite sex, but do not have the surgery, they may be issued a driver's license reflecting their "preferred" gender, but will not be legally (without a new birth certificate) the opposite gender.
